How does Worker’s Compensation work in Colorado?
In Colorado, Worker’s Compensation works in a similar manner to many other states, although some of the specifics, such as Worker’s Compensation Insurance Provider, may be different.

When a worker is injured or develops an occupational disease due to his or her job, that worker is entitled to file a claim for Worker’s Compensation Insurance. This is an insurance policy that pays the worker expenses that were incurred as a result of the injury or disease. These expenses can include medical bills as well as wage replacement due to loss of work as a result of temporary disability.

While Worker’s Compensation might not replace every dollar lost during a health setback, it can go a long way to helping keep a worker’s head above water until he or she is once again able to go back to work.

How long do you have to report an injury at work in Colorado?
When it comes to reporting a Worker’s Compensation claim, time becomes a very important factor. This is because there are several milestones that must be passed within a certain amount of time for a claim to be valid.

The most important one is the actual report of the injury itself. Colorado law states that a worker only has four days — that’s four calendar days, not business days — to report any injury to their employer if he or she wants to receive full compensation benefits. After those four days have passed, a worker can still report their injury, but will take a penalty that results in less compensation. The penalty equals out to one day of compensation lost for each day the injury goes unreported.

After the worker reports the injury, the employer must then report the injury to the insurance company within the next ten days. The insurance company is then allowed to take up to 20 days to review your claim and notify you of its decision of whether or not to accept your claim.

The result? Once you have been injured it can take up to 30 – 35 days before your compensation can even start!

How much does Workman’s Comp pay in Colorado?
Colorado follows a two-thirds rule in compensation payments, which goes like this: if you are completely unable to work, you are eligible to receive payments that are either two-thirds of your average weekly earning, or the state-mandated maximum, whichever is less (as of the 17-18 fiscal year, that max was capped at $948.15 per week).

If you are able to work on a limited basis, you are eligible to receive up to two-thirds of the difference in what you would have earned — again, up to the state-mandated max.

Does workers comp pay for time off for doctor’s appointments in Colorado?
In short: yes! If you have been injured, and your visit is part of an ongoing injury or claim, then the earnings you lose when taking the time off of work to visit the doctor are part of your total lost wages. As mentioned above, those lost wages can be compensated up to two-thirds of whatever was lost, or the weekly allowable cap, whichever is less.
Can I quit my job while on workers comp in Colorado?
Legally, you are allowed to quit your job while on Worker’s Compensation in Colorado. However, you need to be aware of the consequences. Obviously, if you are not working anymore, then you are not earning wages. Since this is due to your choosing to quit, then your employer is off the hook, so to speak — you will not receive compensation for your lost earnings anymore.

In addition, if your injury results in long-term physical problems, it can make it more difficult for you to get or hold down a job. In situations like this, it might be necessary to file a claim for long-term disability, although this is a different topic for a different day.

Do you provide patient care outside of occupational medicine?
No, we do not. All of our patients were injured on the job, and we specialize in facilitating worker’s comp claims and benefits.

Do you treat workplace injuries?
We are not a hospital or emergency room. We see patients that have already been treated for their injuries. Our primary focus is on rehabilitation and accident prevention.
Do you do drug and alcohol screenings?
Yes, as part of our comprehensive approach to accident prevention, we do offer these screenings for employers. Testing can be regulated or unregulated, depending on your needs. Workers can come to the clinic directly, or we can provide testing services onsite. We also specialize in random drug screenings.
Can you do pre-employment drug screening?
Yes, our patients do not have to be employees to get screened. We provide pre-employment testing for many of our clients.
Can you screen an employee for drugs and alcohol after a workplace accident?
Yes. Part of processing a worker’s comp claim is to determine fault. If an employee was drinking or getting high on the job, which led to an accident, it could negate his or her claim. We are equipped to provide such screening whenever necessary.
Do you conduct physicals?
Yes, we can perform physicals as needed for our clients. We also make sure to adhere to OSHA and/or Department of Transportation (DOT) guidelines. Physicals can be done as part of ongoing accident prevention or as a pre-employment screening.
Do you perform specialty examinations?

Yes, we can examine workers for a variety of reasons. Some of our specialty options include fit for duty exams (FFD), independent medical exams (IME), and functional capacity exams (FCE).

What is the difference between physical and occupational therapy?

Physical therapy focuses on the injury directly. Occupational therapy is designed to help patients perform regular daily activities. Both treatment options are provided, and we make sure to treat each patient as necessary to get him or her back to work as soon as possible.

Do you outsource any of your care or treatment programs?

No, we take care of everything in-house. We are doctor-owned, and our team specializes in a variety of techniques. We save our clients money by handling all aspects of work injury care and rehabilitation.
